ChatGPT, an artificial intelligence chatbot developed by OpenAI and backed by Microsoft, was banned in Italy in April due to privacy concerns raised by the Italian data protection authority, Garante. The authority had accused OpenAI of failing to verify the age of users, who are supposed to be 13 or above and launched a probe into the suspected breach.

OpenAI has now successfully addressed or clarified the issues raised by the guarantee and restored access to ChatGPT in Italy.

The company has made its privacy policy accessible to users before registration and added a tool to verify users' ages. It has also provided a new form for European Union users to exercise their right to object to the use of their personal data to train its models.

Garante has welcomed the measures implemented by OpenAI but called for even more compliance, particularly around implementing an age verification system and conducting an information campaign to inform Italians of their right to opt out from the processing of their personal data for training algorithms. The guarantee will continue its fact-finding activities regarding OpenAI under the umbrella of the ad-hoc task force set up by the European Data Protection Board.



OpenAI's Response

An open spokesperson has appreciated the grant for being collaborative and stated that ongoing constructive discussions will continue. Millions of people have used ChatGPT since its launch in November 2022. Microsoft has spent billions of dollars on it and added it to Bing last month. It has also announced plans to embed a version of the technology in its Office apps, including Word, Excel, PowerPoint, and Outlook. Google's rival artificial intelligence chatbot, Bard, is now available, but only to specific users over the age of 18.
